French Employee Termination Compliance: Six Notifications, Five Days, One Action

---

You just terminated an employee. On the last day itself, three mandatory documents must be handed over: the certificat de travail (the work certificate confirming employment dates and job title — legally required under Article D. 1237-19 of the Code du Travail), the solde de tout compte (the final pay calculation, signed by both parties), and the Attestation France Travail — the form that lets the employee immediately register for unemployment benefits.

A five-day compliance clock just started. Six agencies need to know what happened.

The Six Notifications

France's social protection system is more complete than most EU countries. An employee who loses their job retains coverage in the French system for months — and France's compliance obligations for employers reflect that depth.

First, and most urgent: the DSN signalement de fin de contrat (a specific electronic declaration, distinct from the monthly DSN — Déclaration Sociale Nominative — that covers all employee events). This XML event must be transmitted to net-entreprises.fr (France's government platform for employer social declarations) within five calendar days of the last day of the contract. Late filing triggers an automatic URSSAF penalty: €58.88 per employee per late month, no prior warning, no first-offense forgiveness.

Second: France Travail (the unemployment agency, formerly known as Pôle Emploi) receives the attestation electronically on or before the last day of the contract. Since the November 2017 decree, this must be electronic transmission — not a paper form the employee carries with them. Net-entreprises.fr processes this simultaneously with the DSN signalement. When both reach net-entreprises.fr correctly, the ex-employee can register for unemployment the next morning with all employer data pre-filled.

Third and fourth: the mutuelle (complementary health insurance — mandatory for all employees) and prévoyance (disability and life insurance — mandatory for white-collar workers and required by most conventions collectives) providers need portability notifications. ANI portabilité — the national inter-professional agreement of January 11, 2008, extended multiple times — gives ex-employees the right to continue their health and disability coverage for up to 12 months at no personal cost. The employer's existing contributions fund this through the insurance providers. If you don't notify the mutuelle and prévoyance that the employee has left, and they have a health event in the months after departure, your liability for the coverage gap is real and can be pursued years later.

Fifth: CPAM (the Caisse Primaire d'Assurance Maladie — the national health insurance fund) receives notification of the change in the employee's insurance status, typically through the same DSN signalement chain.

Sixth: the employee themselves — with the three day-zero documents and, in many cases, a letter confirming their portability rights.

Take a Lyon restaurant owner who terminates a waiter's CDI (contrat à durée indéterminée — a permanent contract) after completing the full dismissal procedure. Day zero: certificat de travail, solde de tout compte, France Travail attestation transmitted electronically. Days one through five: DSN signalement, mutuelle portability notification, prévoyance notification. End of month: final DSN, which includes the closed contract. Three separate deadline windows. Six separate recipients. All from one employment event.

Why This Gets Missed

Most small businesses handle termination correctly on the obvious parts — they know the employee needs documents. What gets missed is the five-day DSN signalement and the portability notifications.

Portability failure is particularly insidious because it's silent. The ex-employee may not know their rights. The mutuelle may not follow up. Nothing happens — until the ex-employee has a medical event, discovers their coverage lapsed, and traces the gap back to the employer's missed notification. Claims appear months or years after the departure. By then, the employer has often forgotten the details of the termination entirely.

URSSAF's €58.88 penalty for late DSN signalement is small enough that some businesses treat it as acceptable overhead. That's the wrong calculation. A missing signalement also means the ex-employee's unemployment application is delayed, which creates grounds for a Conseil de Prud'hommes (labor tribunal) complaint for failure to deliver mandatory documents on time. A €58.88 URSSAF penalty and a tribunal proceeding are not equivalent risks.

Compliance failures here aren't usually ignorance. Experienced employers know these obligations exist. What happens is operational: the last day of a termination is stressful, the human side of the conversation takes priority, and by the time the emotional dust settles, the five-day window is already on day three.

One Action, Six Consequences

Six notifications flow from the same underlying data: employee ID, last day of the contract, reason for termination, final pay amounts. None of that information changes between notifications. The only reason this feels like six separate tasks is that most payroll software treats them as six separate tasks.

Liberté's approach: record the contract end date. What happens automatically from that single entry — the DSN signalement transmitted to net-entreprises.fr, the France Travail attestation generated and transmitted, portability notifications prepared for mutuelle and prévoyance, certificat de travail generated, solde de tout compte calculated with all mandatory elements (notice period, accrued leave, severance if applicable). The employer confirms each step; the system handles the filing.

Every filing generates a timestamp. That timestamp is your compliance proof. If a labor inspector requests termination documentation, Liberté produces the transmission confirmation from net-entreprises.fr with the filing date, the France Travail attestation reference number, the portability notification records. The employer who manages this manually produces whatever they saved to a folder, if anything.

Before the Next Termination

In France, the day you terminate an employee, you start a five-day compliance clock with six agencies. Your software either handles all six automatically, or you do. There is no third option.

Payfit includes DSN signalement in its standard subscription — at €50-100 per month for a small team. Silae covers it through the accountant billing. These are real solutions, and they work. Liberté provides the same automated chain as part of the free platform.

Setup needs to happen before the termination, not during it. Net-entreprises.fr API connections, mutuelle and prévoyance provider details, France Travail transmission credentials — these need to be configured when you onboard, not on the day you need them.

Any business with employees in France will eventually terminate a contract. When that day comes, the five-day clock starts whether the software is ready or not. Setting up Liberté before the event takes one afternoon. Discovering what the software can't do during the event takes much longer to recover from.
